Application for Insurance
Part I of the act deals with applications for insurance. According to Section 3 (1) of the act, you must show evidence that you have applied for a certificate of insurance, and have been approved, when you apply for a vehicle registration certificate, a driver’s license or any other permit allowing you to operate a vehicle. This also applies to registration, license and permit renewals. This part of the act also applies to vehicles owned by the government of Saskatchewan and the drivers and operators of government vehicles. Before your insurer can approve your application for an insurance certificate, you must supply the insurer with the full basic premium or the first installment if you are paying the premium by regular installments.
Bodily Injury Benefits
If you are injured in a moving vehicle accident, where the vehicle is covered by insurance taken out in accordance with the act, you are entitled to claim against the insurer. According to Part II of the act, this does not apply if the vehicle was not in motion at the time of the accident, nor if it was caused by certain types of vehicle, such as snowmobiles or all-terrain vehicles, listed in Section 20 (3)(b) of the act. Section 21 states that if your claim is successful, you are entitled to claim for medical costs, including surgery, hospital treatment, dental work and physiotherapy.
Accident Report
According to Section 69 of the act, whenever you report a motor vehicle accident to a police officer, you must tell the police officer the name of the person or persons involved in the accident, the nature of any bodily injuries resulting from the accident, and what the vehicle involved in the accident was being used for at the time of the accident. The police officer is allowed to ask any other questions necessary to try to establish the cause of the accident, and the person or persons responsible for the accident. Section 69 (3) states that if a police officer asks you a question relating to the accident, you are legally obliged to comply with the request.
Saskatchewan Auto Fund
Part VII of the act established the Saskatchewan Auto Fund, The Saskatchewan Auto Fund is a compulsory auto insurance program administered by the Saskatchewan Government Insurance (SGI) company. Although SGI administers the driver and vehicle registration program in Saskatchewan, as well as the compulsory auto insurance program, it does not receive government funding, and it does not pay the government money from dividend payments. However, according to Section 89 of the act, all property of the Saskatchewan Auto Fund is the property of the Crown.
